Alliance Phones Terms of Service
These Terms of Service constitute the agreement (“Agreement”) between Alliance Phones (“we”, “us” or “Alliance Phones”) and the user (‘you’, ‘user’ or ‘Customer’) of Alliance Phones hosted business VOIP services (‘Service’). This Agreement governs both the Service and any devices, such as an IP phone, IP Softphone, Analog Telephone Adapter or any other IP connection device, sold or otherwise furnished to You by Alliance Phones (‘Device’ or ‘Equipment’), and also applies to all lines on each Alliance Phones account.
1. EMERGENCY SERVICES “911” DIALING
1.a 911 Dialing.
Alliance Phones 911 Dialing is different than traditional 911 service offered by traditional telecommunications carriers. Most of our customers have access to either basic 911 or Enhanced 911 (E911) service. With E911 service, when you dial 911, your telephone number and registered address are sent to the local emergency center assigned to your location. Customers in locations where the emergency center is not equipped to receive your telephone number and address have basic 911. You must inform any employees and guests present at the physical location about the differences and limitations of Alliance Phones 911 Dialing compared with traditional 911.
1.b Registration of Physical Location Required.
You must register the physical location where you will be using the Service with that phone number. When you move the Device to another location, you must register your new location. If you do not register your new location, calls made using the 911 Dialing feature may be sent to an emergency center near your old address.
1.c Confirmation of Activation Required.
Your 911 Dialing feature will not be activated for any phone line that you are using with the Service unless you receive an email confirming activation for that line.
1.d Service Outages.
911 Dialing does not function in the event of a power failure or disruption. Internet outages will also prevent 911 Dialing from functioning.
1.e Re-Activation Required if You Change Your Number or Add New Numbers.
911 Dialing does not function if you change your phone number or if you add or port new phone numbers to your account, unless you successfully register your location for each changed or newly added phone number.
1.f Network Congestion; Reduced Speed for Routing or Answering 911 Calls.
There may be a greater possibility of network congestion and delays when dialing 911 using our Service compared to traditional networks.
1.g Disclaimer of Liability and Indemnification.
We do not control how calls using our 911 Dialing service are answered or addressed by emergency centers. We disclaim all responsibility for the conduct of these centers.
1.h Alternate 911 Arrangements.
If you are not comfortable with the limitations of the 911 Dialing service, you should consider having alternate means of accessing traditional 911 services.
2. SERVICE
2.a Allowable Increase in Contracted Services.
Customer may increase the quantity of purchased services without adjustment to this contract by providing written notice.
2.b Use of Service and Device.
The Service and Device are provided for commercial use only. You shall not resell, lease, or transfer the Service.
2.c Prohibited Uses.
You shall use the Service only for lawful purposes. We may disconnect your Service without notice if you violate this rule.
3. CHARGES; PAYMENTS; TAXES; DISCONNECTION
3.a Billing.
You must provide a valid billing address and pay the balance on the account within thirty (30) days of receiving your statement.
3.b Billing Disputes.
You must notify us within fifteen (15) calendar days if you dispute any charges on your statement.
3.c Disconnection; Discontinuance of Service.
We reserve the right to suspend or discontinue your Service without cause by providing sixty (60) days notice.
4. LIMITATION OF LIABILITY; INDEMNIFICATION; WARRANTIES
4.a Limitation of Liability.
We will not be liable for any delay or failure to provide the Service. Our aggregate liability shall not exceed the amount received by Alliance Phones during the month when the event leading to the liability occurred.
4.b No Warranties on Service or Device.
We make no warranties about the Service or Device, including but not limited to, the service’s quality or performance.
5. MISCELLANEOUS
5.a Governing Law.
This Agreement is governed by the laws of the State of California.
5.b Mandatory Arbitration and No Jury Trial.
Any dispute arising out of or relating to the Service will be resolved by arbitration in California.
6. FUTURE CHANGES TO THIS AGREEMENT
We may change the terms and conditions of this Agreement with at least ten (10) days written notice.
7. PRIVACY
Your privacy is important to us, and we respect it regarding any information we collect. We will not share your personal information without your consent, unless required by law.
